Terms of Service

These Terms of Service ("Terms") govern access to and use of Trusto's website, applications, and related services (collectively, the "Service") provided by Trusto ("Trusto," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
1. The Service
Trusto provides a security and compliance platform that helps organizations connect integrations, monitor controls, collect evidence, and manage compliance workflows. Features may change over time. We may add, modify, or discontinue features with reasonable notice where practicable.
2. Accounts and organizations
You must provide accurate registration information and keep credentials secure. You are responsible for activity under your account and for ensuring that users you invite comply with these Terms. Organization administrators control integrations, user access, and data connected to their workspace.
3. Acceptable use
You agree not to:
- Use the Service in violation of applicable law or third-party terms (including Google, AWS, GitHub, and other integrated providers);
- Access systems or data without proper authorization;
- Interfere with or disrupt the Service, circumvent security measures, or probe vulnerabilities except as permitted by a written agreement;
- Upload malicious code or use the Service to harm others;
- Reverse engineer the Service except where prohibited restrictions are not enforceable by law;
- Misrepresent your identity or affiliation.
4. Integrations and third-party services
The Service may connect to third-party products and APIs (including Google Workspace, cloud providers, identity providers, and developer tools). Your use of those services is subject to their own terms and policies. By enabling an integration, you authorize Trusto to access and process data from that service as needed to provide the features you select.
For Google Workspace connections, you acknowledge that access is granted via OAuth scopes displayed at authorization time and may be revoked by you or your Google administrator at any time.
5. Customer data
"Customer Data" means data you or your organization submit to or retrieve through the Service, including integration metadata, compliance evidence, and configuration information. You retain ownership of Customer Data. You grant Trusto a limited license to host, process, and display Customer Data solely to provide and improve the Service, support you, and comply with law.
You are responsible for ensuring you have the rights and permissions to connect data sources and share Customer Data with Trusto.
6. Confidentiality
Each party may receive confidential information from the other. The receiving party will use reasonable care to protect confidential information and use it only for purposes related to the Service. This section does not limit handling of Customer Data covered by a separate data processing agreement, if applicable.
7. Subscription, fees, and trials
If you purchase a paid subscription, fees, billing cycles, and payment terms are specified in your order or agreement. Unless otherwise stated, subscriptions renew automatically until canceled. Taxes may apply. Free trials or beta features may be offered "as is" and may be limited or withdrawn at any time.
8. Intellectual property
Trusto and its licensors own the Service, software, branding, and documentation, excluding Customer Data. These Terms do not grant you any rights to our trademarks or proprietary materials except as needed to use the Service.
If you provide feedback, you grant us a perpetual, royalty-free license to use it without restriction or compensation.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUSTO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Trusto helps monitor compliance and security posture but does not guarantee certification, audit outcomes, or that all issues will be detected. You remain responsible for your compliance obligations and security decisions.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER TRUSTO NOR ITS SUPPLIERS OR AFFILIATES WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE.
TRUSTO'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID TRUSTO FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100).
11. Indemnification
You will defend and indemnify Trusto against claims, damages, and expenses arising from your use of the Service, Customer Data, or violation of these Terms or applicable law, except to the extent caused by Trusto's gross negligence or willful misconduct.
12. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access if you materially breach these Terms, pose a security risk, or if required by law. Upon termination, your right to use the Service ends. Provisions that by nature should survive (including ownership, disclaimers, liability limits, and indemnity) will survive.
13. Privacy
Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
14. Changes
We may update these Terms from time to time. If changes are material, we will provide notice through the Service or by email where appropriate. Continued use after the effective date constitutes acceptance of the updated Terms.
15. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws apply in your jurisdiction. Courts located in Delaware will have exclusive jurisdiction over disputes arising from these Terms, unless otherwise required by applicable law.
